Diez elementos clave sobre la gestión de la temporalidad en la Adiministración Pública tras la finalización de los procesos de estabilización. ¿Un nuevo paradigma a partir de 2025?

ABSTRACT: This paper analyses, by means of ten elements that the author considers fundamental, how to cope with the management of temporality in public employment from 2025 onwards, after the end of the stabilization processes of temporary employment that started back in 2022 by Law 20/2021 of December 28th and when the resulting picture is, on the one hand the incorporation of permanent personnel as a consequence of that stabilization, the presence of hundreds of thousands of people with temporary ties in structural positions, some figures for the reduction of temporary employment show a partial failure of the law and the creation of new temporary employment for various reasons, mainly due to the replacement of people due to retirement, which implies an extraordinarily complex management framework.

Algunos ejemplos de buenas prácticas de la utilización de la inteligencia artificial en la gestión de servicios públicos

ABSTRACT: Two of the major problems facing local authorities (hereinafter RLE) are the provision of mandatory public services, due to the configuration of the municipal system, the small-scale farming and the acute depopulation of rural areas. To alleviate the problems of the municipal system and provide public services, there are various alternatives: administrative cooperation; the provision of services by provincial councils, Cabildos and Councils; the implementation of associative formulas such as associations of municipalities. At the present, we must highlight the experiencesthat  the Administration is having with tools based on artificial intelligence (hereinafter, AI). By analyzing various use cases, we will see how using AI-based tools improves the processing of administrative files from the two sides of RLE: the front office, with special reference to the provision of mandatory services, boosting their quality, reducing their cost, and increasing their efficiency; and the back office, implementing AI tools to streamline and automate administrative procedures.

Los derechos digitales del empleado público ante las transformaciones tecnológicas y el uso de la IA en los procesos de gestión de personas

ABSTRACT: The purpose of this paper is none other than to make a first approximation to the impact that technological transformations and the use of artificial intelligence (AI) systems in personnel management may have on the rights of public employees. Our legal system has only reacted very modestly to these new phenomena and has done so insufficiently and belatedly. It has done so by adapting some rights to the new digital era, such as the right to digital disconnection and the fundamental right to privacy when the administration uses video surveillance or geolocation systems, or when it makes digital devices available to its employees for the performance of their duties. These are the so-called ‘digital rights’ in the work environment that were introduced in 2018 with the addition of letter j.bis) to art. 14 of the Basic Statute of the Public Employee. However, this framework of rights needs to be reworked to adapt it to the new reality and, in particular, to the new challenges posed by the use of AI in people management. The Charter of Digital Rights, approved by the Government in 2021, although lacking normative value, provides the legislator with important guidance in this respect.
